If you have received a N.O.T. (Notice of Trustee’s Sale) you must act quickly if you want to stop the foreclosure sale.
The problem will not go away, it will not fix it’s self.

Consult a CPA and an Attorney first. There are complex decisions you will need to make, you need to get advice from true professionals. If you need free or very low cost advice call the Hope Hotline at 888 995-HOPE or go to their webite

Hopefully you have already been trying to get a loan modification from your lenders. This is sometimes a way to reduce your payments enough that you can get back on track. Keep calling them, don’t give up.

Be careful,
There are a lot of scams targeting people in various stages of foreclosure.
Never pay someone a fee to “save you” from foreclosure.
Never sign-over the deed to your house to someone in exchange for help.

One option is to attempt to sell your home, even if you owe more than it’s worth (short-sale). If you can get an offer into the bank before the foreclosure date they will sometimes cancel or delay the foreclosure auction.  It’s important to understand that this will not “save your home”. You will need to move out if you sell it.

The advantage to you is that instead of the stain of foreclosure on your credit, you will have a short-sale or debt-forgiveness. Not good, but less harmful than a foreclosure at auction.

Your foreclosure notice will have a specific date for the auction. You need to have enough time to put the house on the market and get an offer before that date. Most of the time the offer will not be enough to pay-off what you owe. It will be necessary to negotiate with your lenders to accept the lesser amount (short payoff). If they refuse, the house will go to auction and any money received will be split between the various lenders. Most of the time only the 1st loan will get anything.

The financial markets are back in full swing this after the long holiday weekend. The long weekend seems to be just what the battered bond market needed, while Stocks are getting off to a sluggish start due to concerns for the overall global recovery. We saw that last weeks Job Report showed unemployment at a 26 year high for the US, and unemployment is Europe isn’t much better, at its highest level in a decade. This news should help Stocks slide lower and bonds regain some momentum, helping to lower mortgage rates.

Here is a chart showing the ratio of Active listing to Pending listings in the East Bay.

Orange is Pending

Blue is Active

The Black line is the ratio

Active/Pending Raio for East Bay Area

The total height of each bar shows the number of homes on the market.  You can see that today we are at a very low over-all number for sale.

More importantly is the relatively small number of active listings compared to pendings.

This looks like a SELLER’s market.

The current San Ramon real estate market is not what you would think if you only watched the news.

For the past few years I have been compiling MLS data and charting the Active/Pending ratio in various cities of the East Bay.

Here is San Ramon as of 5/1/2009:

The current level of this ratio on this chart looks like a SELLERS market !

This matches my recent experience.

I am currently working with Buyers in Vallejo, Concord, Walnut Creek, Fremont, Tracy, and San Ramon.

By far the most difficult area is San Ramon because of the very limited inventory of sellable homes. We have 2 months (enough homes that if no more came on, all currnt listing would sell in 2 months) on the market, but actually almost half are Tenant occupied short-sales so they are hard to show to my Clients.

San Ramon is special because of the very powerful draw of the school system and because it’s location is central to the East Bay. I spoke with Buyers a few days ago, the wife works in Berkeley, and the Husband work in Fremont. San Ramon is a perfect commute compromise.

But really, it’s all about the schools.

This week I spent a lot of time learning about septic systems, public sewer connections, and some related issues. I drove to 2 separate government offices in 2 separate cities to get first-hand information. My Client is interested in a home with an old septic system.

You probably do not need a Realtor to help you buy a home if you have the time to do this sort of research on your own.

You probably do not need a Realtor if you can use this sort of information to rationally evaluate a property, and consider all risks before you buy something. Most Buyers get emotionally involved in the house, and lose site of potential, future problems.

You probably do not need a Realtor if you understand the limits of California real estate disclosure laws, and can find ways to get necessary information before you get the keys.

You probably do not need a Realtor if you know how to package a REO offer in a way that the bank will like.

You probably do not need a Realtor if you know how to get the best possible price, and terms even if information about the property is incomplete.

You probably do not need a Realtor if you already have a good one.

It’s been a very busy week for me.

I am working with buyers in Vallejo,  San Pablo,  Berkeley,  Concord,  San Leandro, and Alamo.

I haven’t seen this much buyer activity for at least 3 years.

We are reaching a price point in many areas where it’s cheaper to own than to rent. We haven’t been there for 5 years.

Certainely nobody knows when real estate in the East Bay will start to appreciate again. My current buyers are all long-term thinkers and are buying properties which make sense today, even if they do not go up in value.

It was a special feeling today with the innaugeration of President Obama.

One of the wonderful things is that to my kids, it’s not particularly remarkable. They will grow into adults with the new,expanded possibilities being a self-evident part of their own experience.

When divisive things become non-remarkable they lose their destructive power.

WE THE PEOPLE deserve to be proud today.
